Temporary suspension of access to an online course policy

SUALCA Enterprise Development (Pty) Ltd  (“the Company”) aims to promote a fair, accessible and sustainable marketplace for the provision of the courses (“the Courses”) it provides to participants (“the Participants”) and to avoid unfair marketing and business practices. The Company therefore deals with suspensions of access to Courses purchased and registered for in accordance with this policy.

The nature of the provision of Courses has been outlined within the Standard Terms and Conditions. The following sequence of events occur upon the purchase of and registration for a Course by a Participant:

1. The Participant will complete the application form and make payment for the Course purchased.
2. Upon receipt of payment, the Participant is granted access to the Course including the associated content.
3. The Course Access Period to complete the course, via prerecorded videos in accordance with the Course sequence is then immediately in effect.
4. The downloadable documentation relating to the particular section/lesson of the Course, as well as on selected topics, becomes available to the Participant as the Participant progresses through the Course in the predetermined sequence.

In essence the Participant has purchased the right to access the Course and the associated content for the Course Access Period from the Company.

The Company recognizes that events or circumstances may arise that could prevent the Participant from completing the Course within the Course Access Period. In the alternative to the refund policy and exercising its discretion to grant a refund to such a Participant, the Company may consider the temporary suspension of a Course without the option of a refund. The suspension of a Course will be considered in the following circumstances:

• A Participant becoming temporarily medically incapacitated.
• A Participant being relocated by his/her employer to a location where a stable internet connection is unavailable.
• A Participant being assigned by their employer to another training course of a full time nature and where it is impractical to attend both courses simultaneously.
• Exceptional events of a personal nature that would negatively impact the Participant’s ability to focus on a training Course.
• Other exceptional circumstances or events beyond the control of either party where temporary suspension of access is considered, by the Company in its sole and absolute discretion, a fair outcome and of benefit to both parties.

It is the duty of the Participant to notify the Company of any circumstance that would impact the completion of the Course in advance of the expiration of the Course Access Period. This will provide fair and reasonable time for both parties to engage in discussion with the intention of reaching a mutually acceptable resolution. Should the Participant fail to notify the Company of the event prior to the expiration of the Course Access Period, the Participant is deemed to have forfeited the right to the Suspension of the Course and access to the Course beyond the Course Access Period will only be granted to the Participant upon the receipt of the relevant re-activation fee.

In the event where it has been agreed to temporarily suspend access to the Course, the Company will reinstate access to the Course upon such date as mutually agreed to by both Parties. Upon such mutually agreed date, the Participant will be granted access to the Course and may continue with the Course. All progress achieved prior to the agreed suspension shall remain intact and the Participant will be able to recommence with the Course from the point of last progression.
